At TitanBody™, we are committed to providing the most advanced products and customer experience while protecting your privacy and information as our valued customer. The following privacy policy describes how TitanBody™ LLC and its subsidiaries, parents, and affiliated companies (“TitanBody,” “we,” or “us”) collect, use, and share your personal information when you use our website (www.titanbody.com) (the “Site”), the TitanBody mobile application (the “App”), and purchase or use our products and services (collectively, the “Services”). By submitting information to us, or by continuing to use the Site, App, or any of our Services, you agree to this privacy policy (“Privacy Policy”).

1. Information We Collect

We collect information from you in several ways: directly from you, automatically through your use of the Site and App, and from third-party sources.

1.1 Information You Provide Directly

When you make a purchase, create an account, contact support, or interact with our Services, we may collect:

  • Name, billing address, and shipping address
  • Email address and phone number
  • Payment information (credit card numbers, billing details) processed through third-party payment processors
  • Date of birth, height, weight, and gender
  • Profile photos or images you upload
  • Social media profile details (when you connect accounts)
  • Account preferences, product/service history, and survey responses
  • Any other information you voluntarily provide through forms, emails, or customer support interactions

1.2 Information Collected Automatically Through the App

When you download, install, or use the TitanBody App, we automatically collect the following categories of data:

a) Location Data

  • Precise geolocation data (GPS coordinates) collected during active App sessions
  • Approximate location derived from IP address, Wi-Fi, or cellular network data
  • Location data is used to provide location-relevant features, analyze regional usage patterns, and improve our Services
  • You may disable location services through your device settings at any time; however, certain App features may not function properly without location access

b) Usage & Activity Data

  • Workout session data: duration, frequency, EMS intensity levels, preset selections, muscle group activation, and session timestamps
  • App navigation behavior: screens viewed, features used, buttons tapped, time spent on each screen, and interaction sequences
  • Training program progress and completion data
  • PowerBox connection events, Bluetooth pairing history, and firmware version
  • In-app preferences, settings changes, and notification interactions

c) Device & Technical Data

  • Device type, model, manufacturer, and operating system version
  • Unique device identifiers (e.g., IDFA, GAID, device ID)
  • App version, SDK versions, and crash/error logs
  • IP address, browser type, and network connection type (Wi-Fi, cellular)
  • Push notification tokens and notification interaction data
  • Battery level at time of workout sessions
  • Accelerometer, gyroscope, and motion sensor data when used for workout tracking

d) Health & Fitness Data

  • EMS training metrics and performance data
  • Workout history and progress over time
  • Body measurements you input (height, weight, body composition if provided)
  • Any health-related information you voluntarily provide

Note: We treat health and fitness data with heightened security measures. This data is never sold to third parties and is used solely to provide and improve the TitanBody training experience.

1.3 Information Collected Through the Site

When you visit our Site, we automatically collect certain information through cookies, pixel tags, and similar technologies:

  • IP address, browser type, referring/exit pages, and operating system
  • Pages viewed, links clicked, time spent on pages, and browsing patterns
  • Information collected through cookies, web beacons, and similar tracking technologies (see Section 3 below)

  • Send transactional communications (order confirmations, shipping updates, support responses)

  • Send push notifications through the App (you may disable these in your device settings)
  • Deliver targeted advertising on third-party platforms

3. Cookies, Tracking Technologies & Third-Party SDKs

3.1 Cookies

3.2 Pixel Tags / Web Beacons

We use pixel tags (also known as web beacons) in our Site and emails to track engagement, measure the effectiveness of our communications, and understand what content resonates with users.

  • Email Tracking: You may disable image loading in your email client to prevent pixel tracking

4. How We Share Information

We will never sell or rent your Personal Information. We may share it in the following limited circumstances:

4.1 Service Providers

We share information with third-party service providers who perform services on our behalf, including payment processing, shipping and fulfillment, email and SMS marketing, analytics, cloud hosting, customer support tools, and fraud prevention. These providers are contractually obligated to use your information only as necessary to perform their services.

4.2 Business Transfers

In the event of a merger, acquisition, bankruptcy, reorganization, or sale of assets, your Personal Information may be transferred as part of that transaction. We will notify you via email and/or a prominent notice on our Site of any change in ownership or uses of your Personal Information.

4.5 Aggregated or De-Identified Data

We may share aggregated, anonymized, or de-identified data that cannot reasonably be used to identify you. This data may be used for industry analysis, research, marketing, or other business purposes.

5. Data Retention

We retain your Personal Information for as long as necessary to fulfill the purposes described in this Privacy Policy, including:

  • Account Data: Retained for the duration of your active account, plus 3 years after account deletion or last activity
  • Transaction Data: Retained for 7 years to comply with tax, accounting, and legal obligations
  • App Usage & Workout Data: Retained for the duration of your active account. Upon account deletion, this data is purged within 90 days, except where retention is required by law
  • Location Data: Retained in identifiable form for no longer than 24 months. After that period, location data is either deleted or aggregated and anonymized
  • Marketing Data: Retained until you unsubscribe or request deletion
  • Support Communications: Retained for 3 years after resolution

Some data may remain in encrypted backups or archives as required by our data retention policies or legal obligations. When data is no longer needed, we securely delete or anonymize it.

6. How We Protect Your Information

We implement reasonable administrative, technical, and physical security measures to protect your Personal Information, including:

  • Encryption of data in transit (TLS/SSL) and at rest
  • Access controls limiting employee access to Personal Information on a need-to-know basis
  • Regular security assessments and vulnerability testing
  • Secure payment processing through PCI-DSS compliant processors

No method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security. By using our Services, you acknowledge this inherent risk.

We encourage you to keep your login credentials private, use strong passwords, and log out after using shared or public devices.

7. Children’s Privacy

Our Services are not directed to children under the age of 13 (or 16 in the EEA). We do not knowingly collect Personal Information from children under 13 without verifiable parental consent. If we become aware that we have collected Personal Information from a child under 13 without parental consent, we will take steps to delete that information promptly.

TitanBody is based in the United States. If you access our Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States and other countries where our service providers operate. By using our Services, you consent to the transfer of your information to the United States and other jurisdictions as described in this Privacy Policy. Where required by applicable law, we will ensure appropriate safeguards are in place for such transfers, including Standard Contractual Clauses or other mechanisms approved by relevant data protection authorities.

9. Your Rights and Choices

9.1 All Users

Regardless of your location, you may:

  • Access: Request a copy of the Personal Information we hold about you
  • Correction: Request correction of inaccurate or incomplete information
  • Deletion: Request deletion of your Personal Information, subject to legal retention requirements
  • Opt Out Of Marketing:  Unsubscribe from promotional emails at any time by clicking the “unsubscribe” link or contacting support@titanbody.com. Transactional emails related to orders will still be sent
  • Push Notifications: Disable push notifications through your device settings
  • Location Services: Disable location tracking through your device settings at any time

9.2 California Residents (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):

  • Right to Know: You may request the categories and specific pieces of Personal Information we have collected, the sources, the business purposes for collection, and the categories of third parties with whom we share it
  • Right to Delete: You may request deletion of your Personal Information, subject to certain exceptions
  • Right To Correct: You may request correction of inaccurate Personal Information
  • Right To Portability: You may request a copy of your Personal Information in a portable, readily usable format
  • Right To Opt Of Of Sale/Sharing: TitanBody does not “sell” Personal Information as defined by the CCPA. We do not share Personal Information for cross-context behavioral advertising
  • Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights

9.3 California Shine the Light

California residents may request (once per year) a list of third parties with whom we shared Personal Information for direct marketing purposes in the prior calendar year. To request, email support@titanbody.com with “California Privacy Rights” in the subject line.

9.4 European Economic Area, UK & Swiss Residents (GDPR)

If you are located in the EEA, UK, or Switzerland, you have additional rights under the General Data Protection Regulation (GDPR) and equivalent legislation:

  • Right of access to your Personal Information
  • Right to rectification of inaccurate data
  • Right to erasure (“right to be forgotten”)
  • Right to restriction of processing
  • Right to data portability
  • Right to object to processing based on legitimate interests or direct marketing
  • Right to withdraw consent at any time (without affecting the lawfulness of prior processing)

Our legal bases for processing your Personal Information include: consent, performance of a contract, compliance with legal obligations, and legitimate interests (such as fraud prevention, product improvement, and security).

10. Text Messaging

By entering your phone number at checkout, subscribing via a form, or using a keyword, you agree that we may send text notifications including transactional messages, abandoned cart reminders, and promotional offers.

  • Frequency: up to 10 messages per month
  • Consent is not a condition of purchase
  • To unsubscribe, reply STOP at any time. For help, reply HELP
  • Message and data rates may apply
  • We do not share your phone number with third parties for their marketing purposes

11. Third-Party Links

Our Site and App may contain links to external websites, applications, or services not controlled by TitanBody. This Privacy Policy does not apply to those third-party services. We encourage you to review the privacy policies of any third-party services you access through our platform.

12. Do Not Track Signals

Some browsers transmit “Do Not Track” (DNT) signals. We do not currently respond to DNT signals due to a lack of industry standardization. However, you can manage your tracking preferences through the cookie and device settings described in Section 3.4.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will notify you by posting the updated policy on our Site with a new “Last Updated” date. For significant changes, we may also provide additional notice via email or in-App notification. Your continued use of the Services after any changes constitutes your acceptance of the updated Privacy Policy.
